These General Terms and Conditions apply to all requests for settlement-free interconnection between Your and Nokia Corporation of Keilalahdentie 2-4, 02150 Espoo, Finland, including its affiliates (each, a “Party”; jointly, the “Parties”) regional Internet Networks via traffic exchange at a multi-party network access point (“peering”). In order to be able to initiate and/or continue peering with Nokia, You have to comply with the following terms.
You must supply a fully staffed Network Operations Center or equivalent that operates and is reachable on a 24-hours-a-day and 7-days-a-week basis.
You must establish and maintain traffic exchange links of a sufficient robustness, aggregate capacity, and geographic dispersion to facilitate mutually acceptable performance across the interconnect links. There is no minimum number of peering points; however, we request that You peer with Nokia in all Internet Exchange Points where we are mutually present.
Both Parties shall be responsive to unsolicited bulk email, hacking, Denial of Service, and other network security and abuse issues. A good faith effort shall be made to provide a qualified network engineer to trace ongoing network attacks within a reasonable amount of time.
You must be listed and provide updated contact information (if applicable) on PeeringDB.com. Further, You shall maintain Your IRR info and macro up to date so that Nokia may use them for our routing policies.
Both Parties shall maintain consistent route announcements, in terms of prefix aggregation properties, across all interconnect locations.
You shall strive to use BGP MD5 authentication.
You are expected to enforce filtering to reject unauthorized BGP announcements and aggregate prefixes announced as well as filter their prefixes to deny IP datagrams with invalid source addresses.
You shall keep Nokia up to date with the maximum number of prefixes to be advertised / received so that Nokia may adjust its filters accordingly.
Neither Party shall abuse the peering relationship in any way. Neither Party shall establish a static route, a route of last resort, or otherwise send traffic to the other party for a route not announced via BGP. Neither Party shall alter, sell, or give next-hops to a third party. Neither Party shall use the other Party's network for transit, or engage in any other routing manipulation that causes the other Party's network to provide transit to peers.
Nokia reserves the right to grant or refuse peering, regardless of whether You would otherwise meet the requirements set forth in these General Terms and Conditions. Nokia reserves the right to amend these General Terms and Conditions from time to time and Your continued peering after an amendment has been publicly informed by Nokia constitutes acceptance of the relevant amendments.
Both You and Nokia have the right to terminate the peering connection for any reason at any time. The terminating Party should deliver a written notice to the other Party. In case of such termination notice the Parties will use all reasonable efforts to immediately cease all peering activities between them.
THE PARTIES EXPRESSLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES REGARDING THE PEERING INTERCONNECTION, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. THE PARTIES ACKNOWLEDGE AND ACCEPT THAT THE OTHER PARTY’S PERFORMANCE UNDER THIS AGREEMENT IS PROVIDED “AS IS” AND “AS AVAILABLE” AND THAT IT WILL NOT NECESSARILY MEET THE REQUIREMENTS OR DEMANDS OF THE OTHER PARTY OR END-USERS OR BE UNINTERRUPTED OR ERROR-FREE.
IN NO EVENT SHALL EITHER PARTY BE LIABLE TO THE OTHER PARTY, ITS CUSTOMERS OR ANY THIRD PARTY FOR ANY LOST OR DISTORTED MESSAGES, DAMAGE TO OR DESTRUCTION OF DATA, INFORMATION FILES OR DATABASES OR ANY OTHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL OR OTHER DAMAGES, LOST PROFITS, BUSINESS REVENUE, GOODWILL, ANTICIPATED SAVINGS, RESULTING FROM THE PERFORMANCE OR NON-PERFORMANCE OF EITHER PARTY UNDER THIS AGREEMENT.
